Terms of Service Agreement
General
This is the most recent Terms of Service agreement as of January 1, 2024.
By using any of Social Surf’s services, you are accepting all of Social Surf’s terms and conditions and acknowledge our privacy policy. If you do not accept these terms and conditions, do not use Social Surf services.
Any changes to these terms & conditions in the future will modify and replace all former agreements.
The term “Client” refers to any individual or entity that has purchased services from Social Surf.
Service
Social Surf will be used solely for promotional purposes for your account/s.
Social Surf is not liable for any engagement (likes, comments, messages, follows, etc) that occur due to followers gained through our services. Engagement appropriateness is the user’s responsibility.
Social Surf cannot guarantee the demographics of followers gained, as this depends on each influencer’s specific audience.
By signing up for Social Surf, you consent to receiving periodic promotional newsletters about new services, products, and news.
For hourly billed services, rates vary based on the specialization of team members. Your timesheet will reflect these rates.
Intellectual Property
Upon full payment, intellectual property rights, except for generative AI media, are transferred to the client. Social Surf retains rights if there’s an outstanding balance.
Social Surf grants a worldwide license for generative AI media use, revocable at any time.
Guarantees
Social Surf guarantees to set up accounts within 48 hours. If accounts are not set up within the 48 hours, clients will be granted credits or a full refund along with their cancellation. Specific guarantees apply to various services as outlined on our pricing page. No guarantees are offered for certain services like engagement or followers gained.
Payment
Recurring payments commence on the start date and recur every 30 days. Automatic renewal occurs unless canceled before the next billing cycle.
Non-Disclosure & Non-Solicitation
Clients agree not to disclose confidential information or solicit Social Surf’s customers, suppliers, or employees.
Registration
Clients must be at least 18 years old and provide necessary account information. Cancellation policies apply as detailed.
Copyright
No part of Social Surf’s website or services may be copied without written consent.
Reviews & Public Usage
Social Surf may use client information for commercial purposes, subject to specific conditions.
Liabilities
Social Surf is not liable for account issues or data loss due to external factors like social media platform policies.
Disclaimer
No guarantees are made regarding the impact of Social Surf’s services on your business, except as explicitly stated.
Change of Terms
Terms of Service are subject to change, effective upon posting on the website.
Refund Policy
A refund can be granted if service was never set up or if absolutely no engagement or followers were gained during the subscription period.
Credit Policy
Credits may be offered on a case-by-case basis as an alternative to refunds.
Disputes
Dispute resolution involves mediation, with legal proceedings governed by the laws of Delaware.
Non-Payment
Late fees apply to overdue invoices, with possible service suspension.
General Provisions
Standard legal provisions apply, including notice requirements, severability, and governing law.
Entire Agreement
This document represents the full agreement between Social Surf and its clients.
